REPORT: The 2025 State of Contracting

Podcast: Everything's Different, Yet Everything Is the Same – Featuring IACCM

Clearly, the world has changed in material and unfathomable ways in recent months; it has certainly changed since IACCM released its last Most Negotiated Terms Report in 2018. That 2018 report outlined the negotiation priorities for contracting teams (Limitation of Liability, Indemnification and Price Change); it also served as a call to action in reaction to the glacial pace of change in the industry's approach to contracts and negotiation.

That was then, but what about now? With the passage of time and the radical change in the business world driven by the COVID-19 pandemic, surely contracting has changed? If so, in what ways?

The answer to these questions may lie in the highly anticipated 2020 Most Negotiated Terms Report. Now in its 20th year, IACCM is currently collecting feedback on the report analyzing responses; the full report and analysis will be released in October.

Prior to its release, IACCM President Tim Cummins sat down with Bernadette Bulacan, Lead Evangelist at Icertis, and Will Morris, Chief Counsel at Rolls-Royce, and provided them with an early look at the incoming results. This IACCM podcast, "Everything's Different, Yet Everything is the Same" shares their initial reactions to the forthcoming 2020 Most Negotiated Terms- Managing Risk in a post-COVID-19 World.
